Photograph: Kevin Carter/Getty Images US supreme court backs FCC in clash with wireless carriers over fines Justices uphold FCC authority to impose in-house penalties, rejecting AT&T and Verizon jury trial claims Sign up for the Breaking News US newsletter email The US supreme court backed the Federal Communications Commission’s system for levying fines, ruling on Thursday against wireless carriers AT&T and Verizon in their challenge to the agency and handing a win to Donald Trump ’s administration. The ruling was 8-1. At issue in the legal dispute was whether the agency’s in-house proceedings for imposing the penalties deprived the companies of their right to a jury trial under the US constitution. Trump’s administration defended the FCC’s system for assessing financial penalties, known as forfeiture orders. The conservative chief justice, John Roberts, authored the ruling. Clarence Thomas, a conservative justice, was the court’s lone dissenter. The court embraced the Trump administration’s argument that the FCC’s in-house system does not stop parties from bringing legal challenges to the agency’s assessments. The legal dispute marked the latest case to test whether a federal agency’s internal enforcement arrangement violates the constitutional right to a jury trial after the supreme court in 2024 curbed the power of in-house proceedings at the Securities and Exchange Commission . The FCC fined AT&T $57m and Verizon nearly $47m after the agency concluded that the companies had unlawfully sold access to customer location data to third parties without securing the consent of users. In all, the FCC imposed nearly $200m in fines on carriers that it said failed to safeguard customer data. It fined T-Mobile $80m and Sprint, which T-Mobile acquired in 2020, $12m. Verizon and AT&T paid the fines they were assessed, but also filed legal challenges that eventually led to a split among regional US appellate courts over the lawfulness of the FCC’s in-house procedure for imposing the penalties. In the government’s defense of the FCC’s in-house system, justice department lawyers had argued that the agency’s assessments were not binding. If the government were to bring an enforcement action in court, it would allow the companies to make their case before a jury, the lawyers argued. The companies, for their part, said that the FCC’s system impermissibly uses in-house proceedings for a process that belongs in court, depriving them of their right to a jury trial. Photograph: Xinhua/Shutterstock UK car sales hit post-Covid high as Chinese EV makers gain ground Registrations are up 7% in May, with battery electric vehicles recording the fastest growth and Tesla jumping 45% British car sales rose in May to their strongest level for the month since before the Covid pandemic, driven in part by strong growth from the Chinese manufacturers BYD and Chery. Car registrations rose 7% to 160,662 during the month, according to figures from the Society of Motor Manufacturers and Traders (SMMT), a lobby group. Sales of battery electric cars rose the fastest, accounting for more than 27% of the market. Chery sold 8,200 cars during May across its Chery, Jaecoo and Omoda brands , while BYD sold 5,200. Over the first five months of the year BYD’s sales doubled, while Chery’s increased fourfold. Sales of cars from MG, which is owned by China’s state-owned SAIC, grew by 13% to nearly 7,500. Sales of vehicles by China’s Leapmotor and Geely surged to 900 and 1,100 respectively, after barely selling any a year earlier. China’s manufacturers have poured new cars into the UK , which has not imposed punitive tariffs on imports. At the same time, demand for electric cars – an industry dominated by China – has risen since the introduction of grants last July, and by rising fuel prices caused by the US-Israeli war in Iran . Higher demand for electric vehicles did not benefit only Chinese carmakers. America’s Tesla, run by Elon Musk, recorded a 45% sales increase during the month, although sales over the year so far are up only 3%. The news comes ahead of an initial public offering for another of Musk’s companies, SpaceX, which is aiming for a valuation of $1.77tn , which would make it the largest in history. Mike Hawes, SMMT’s chief executive, said: “Britain’s car buyers are responding to a market offering more choice than ever, from both new and familiar brands, resulting in a robust May.” The SMMT said private buyers, rather than corporate fleets, were responsible for the strongest May increase in sales since 2019. Sue Robinson, chief executive of National Franchised Dealers Association, which represents retailers, said the “encouraging” figures showed that consumers were “increasingly considering lower-emission motoring options due to the continued high price of fuel”. The strong growth in electric sales makes it likely that carmakers will comply with the zero emission vehicle (ZEV) mandatory sales targets for electric cars. Electric sales were below the 33% headline proportion of required sales, but New AutoMotive, a thinktank tracking the transition to electric cars, estimates that the true target is about 24.6% because of large flexibilities built into the rules.
